These Terms of Service (“Terms”) govern your use of premierlandservice.com (the “Site”) and any estimates, proposals, or services provided by Premier Land Service LLC (“Premier Land Service,” “we,” “us,” or “our”). By using the Site or requesting an estimate, you agree to these Terms.

1. Use of the Site

The Site is provided for informational purposes and to allow you to request estimates and contact us. You agree not to misuse the Site, attempt to gain unauthorized access, scrape content for resale, submit false information, or use any automated tool to interfere with the Site’s operation.

2. Free Estimates Are Not Binding Contracts

Premier Land Service offers free estimates as a courtesy. An estimate is not a contract and is not binding on either party until a written proposal or work order is signed by both Premier Land Service and the client. Estimates are based on the information you provide and our preliminary review. Final pricing is subject to:

  • An on-site evaluation by Premier Land Service
  • Soil, terrain, vegetation density, slope, and access conditions
  • Underground utilities, septic, well, or buried structures encountered
  • Permitting, easement, and regulatory requirements
  • Weather, fire restrictions, and seasonal access limitations
  • Material, fuel, and equipment costs at the time of work

Estimates are valid for 30 days from issue unless stated otherwise.

3. Scope of Work and Change Orders

The signed proposal or work order defines the scope. Any change to scope, materials, or schedule — whether requested by the client or required by site conditions discovered during work — will be documented in a written change order before being performed. Change orders may adjust price and schedule.

4. Payment Terms

  • Deposit: 50% of the contracted amount is due at project start.
  • Final payment: 50% is due upon completion, before equipment leaves the site unless otherwise agreed in writing.
  • Accepted methods: ACH, check, cash, and Bitcoin.
  • Credit card: a 3% processing fee applies to credit card payments.
  • Financing: Affirm financing is offered on qualifying projects through a third party; the third party’s terms apply.
  • Late payment: balances unpaid 10 days after completion accrue interest at 1.5% per month (18% APR) or the maximum allowed by Idaho law, whichever is lower, plus reasonable collection and attorney fees.
  • Mechanic’s lien: Premier Land Service reserves the right to file a lien under Idaho Code Title 45, Chapter 5, for unpaid balances.

5. Site Access, Utilities, and Property Lines

Client is responsible for:

  • Identifying and clearly marking property lines, easements, septic components, irrigation, well lines, propane, and any private buried utilities not covered by Idaho Dig Line (“Digline”) at 811.
  • Providing safe, legal access to the work area for trucks and equipment.
  • Securing any required permits, HOA approvals, or landowner permissions where applicable.

Premier Land Service will request a public utility locate before excavation. We are not liable for damage to unmarked or mismarked private utilities, structures, irrigation, or landscape features outside the scope of work, except where caused by our gross negligence.

6. Weather, Fire, and Force Majeure

Schedules are estimates. We may delay or reschedule work due to weather, ground conditions, fire restrictions, smoke and air-quality limits, equipment failure, supply-chain delays, or any cause outside our reasonable control. Such delays do not constitute breach.

7. Cancellation

  • Either party may cancel before the deposit is paid.
  • After deposit, cancellation by client forfeits any non-recoverable mobilization, permitting, or material costs already incurred.
  • Cancellation within 7 days of scheduled start may incur a mobilization fee.

8. Warranty and Limitation of Liability

Premier Land Service warrants that work will be performed in a workmanlike manner consistent with industry standards in North Idaho. Except as expressly stated in a signed proposal, we make no other warranties, express or implied, including no warranty of merchantability or fitness for a particular purpose. Vegetation regrowth, soil settlement, drainage outcomes during extreme weather, and similar natural processes are not warrantied.

To the maximum extent permitted by law, Premier Land Service’s total liability for any claim arising from the Site or our services is limited to the amount paid by client for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Photography and Project Documentation

Premier Land Service may photograph or video completed work for portfolio, marketing, and training use. Photos generally do not show identifying information. Clients who wish to opt out should notify us in writing before work begins.

10. Site Content and Intellectual Property

All Site content — text, photos, logos, and design — is owned by or licensed to Premier Land Service LLC and is protected by U.S. copyright and trademark law. You may view and share links to the Site for personal, non-commercial use. Reproduction, scraping, or commercial reuse without written permission is prohibited.

11. Informational Content Disclaimer

Articles and pages on the Site (including septic, drainage, retaining-wall, fire-fuels, and forestry content) are general information based on our field experience. They are not engineering, legal, or regulatory advice. Site-specific recommendations require an on-site evaluation.

12. Governing Law and Disputes

These Terms and any agreement for services are governed by the laws of the State of Idaho, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Bonner County, Idaho. The parties agree to attempt good-faith resolution before filing suit. The prevailing party in any action is entitled to recover reasonable attorney fees and costs.

13. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above reflects the most recent change. Continued use of the Site after changes are posted constitutes acceptance.
